When the boy was 8, Busfield allegedly touched him five or six times during a separate incident.
According to the affidavit, the boy was “very afraid of Tim and was relieved when he was out of the game.”
The boy also said he was “afraid to tell anyone because Tim was the principal, and I was afraid Tim would get mad at him.”

According to the legal document, the boy has been diagnosed with post-traumatic stress disorder and anxiety since the incident.
The document also said that the West Wing The actor spoke to police over the phone about the allegations against him in November 2025 and was asked if he had any “physical contact” with the children, such as picking them up or tickling them.
“Timothy said it was very likely that he would,” the affidavit said, adding that Busfield described the set as a “playful environment.” The document said Busfield added that “there would never be any awkward moments” and that any contact would be “in front of the parents”.
The Emmy Award winner later added during the police interview that he did not specifically remember picking up the boys at any time.
“I don’t remember those guys,” he said, according to the affidavit. “No, I don’t. I actually don’t remember, if it happened. I don’t remember openly tickling boys ever, but it wouldn’t be strange to me.”
