A father was sentenced to time served after allegedly punching a 6-month-old boy in the face during a physical fight with the boy’s mother.
In December, Avery Maps23 years old, was arrested by Toledo police for physically assaulting his fiancee and her baby, who had been cradled in his arms at the time of the altercation. He was later charged with assault, child endangerment, domestic violence, obstruction and disorderly conduct/public intoxication.
After the incident, his fiancée showed “several marks and bruises” on her body and police reportedly found “bloody handprints” on the back of her sweatshirt. The boy had “multiple red marks and bruises,” according to court documents Law and crime.
“The defendant deliberately caused physical harm to the victim, her live-in fiancé, the mother of his child. The defendant became intoxicated and ran towards the victim, attempting to hit her,” statement of probable cause to read “This happened in Lucas County, in the city of Toledo. The victim and this officer (are) the source of the information.”
The couple went to the hospital with their baby after the incident, where Mapes allegedly “went into a rage,” yelled “racial slurs” and “tried to bite” the officers several times. He also allegedly tried to “fuck and hit” hospital employees.
Mapes initially pleaded not guilty, but later changed his plea to “no contest” to the child endangerment charge. As a result, her assault, obstruction and disorderly conduct charges were dismissed and her domestic violence charge was amended to negligent assault.
A judge ordered him to serve just 60 days behind bars, as well as a year of probation.
according to Ohio State Child Endangerment Lawsno person who is a parent, guardian or in control of a child under the age of 18 may abuse, torture, administer corporal punishment or other forms of discipline “in a cruel manner or for a prolonged period” or “repeatedly administer unjustified disciplinary measures to the child, when there is a “substantial risk” that it may cause “slow, if continued, development” or “a substantial risk.”
An Ohio Bar Reports that a first offense for this offense is considered a misdemeanor of the first degree and the consequences can include “up to 6 months in jail and a fine of up to $1,000.” Penalties can increase depending on how many prior convictions the person has.
Negligent assault is considered a misdemeanor of the third degree and it is defined as someone who “by means of a deadly weapon or dangerous ordinance, as defined in (Ohio state law), causes physical harm to another person or to another person’s child.” It is punishable by up to 60 days in jail.
This means that Mapes could theoretically have received a much stronger sentence than he did.
