Erika Kirk has accused Tyler Robinsonthe man suspected of having killed her husband, Charlie Kirkof trying to delay his trial.
An attorney for Erika, 37, filed for a speedy trial in the case against Robinson, 22, on Friday, Jan. 16, according to multiple reports.
“No one believed in the importance of the United States Constitution more than Charlie Kirk,” Atty Jeffrey Neiman wrote in the presentation, 2KUTV informed “And while the United States Constitution guarantees many rights to criminal defendants, it does not guarantee them the right to cause undue delay.”
The filing also noted that Utah Code gives crime victims “the right to a prompt disposition of charges without undue delay caused by or at the behest of the defendant,” according to the filing. ABC4.
“This court is charged with the important function of ensuring that the defendant has a fair trial, but this court must also do so while balancing Ms. Kirk’s right to a speedy trial,” Neiman continued in the filing, the outlet reported.
The filing came on the same day as Robinson’s most recent court appearance, where his defense team sought to disqualify the prosecution because of an alleged conflict of interest.
The defense argued that the Utah County District Attorney’s office should not be involved in the case because the daughter of a deputy county attorney attended the Turning Point USA event where Charlie, 31, was shot on Sept. 10, 2025.
“It is with heavy hearts that we, the Turning Point USA leadership team, write to notify you that early this afternoon, Charlie went to his eternal reward with Jesus Christ in heaven,” Turning Point USA, which was Charlie’s nonprofit organization, said in a statement at the time, confirming the influential politician’s death.

After Charlie’s death, several suspects were questioned before Robinson finally turned himself in, according to law enforcement.
In September, prosecutors claimed they acquired an alleged text exchange between Robinson and his roommate, which allegedly revealed Robinson’s motive for the murder.
“I had a chance to take Charlie Kirk out and I’m going to take it,” the alleged text read. “I had enough of their hate. Some hate can’t be negotiated.”
Robinson was charged with aggravated murder, felony discharge of a firearm and felony battery in the presence of a child. He also faces two counts of obstruction of justice and witness tampering. He has not submitted any allegations yet. Prosecutors are reportedly considering the death penalty.
Robinson first appeared in court in December 2025. Apparently he kept his cool as he smiled while sitting with his legal team.
Erika publicly forgave her husband’s killer in September 2025.
“I forgive him because that’s what Christ did,” Erika, who shared two children with Charlie, said during his memorial service. “The answer to hate is not hate.”
