Kristy Scott Divorce Filing: Custody, Property & Adultery Claims (Excl.)


Kristy Scott laid bare what allegedly went wrong in their marriage Desmond Scott and her plans for child custody, property division and more in her divorce petition obtained exclusively by Us Weekly.

Kristy, 30, she asked for a divorce from her husbandaged 31, after 11 years of marriage on December 30, 2025, stated: “Desmond Scott has committed adultery.”

In her petition filed in Harris County, Texas, Kristy stated that her marriage “has become untenable due to discord or conflict of personalities,” noting that it “destroys the legitimate goals of the marital relationship and precludes any reasonable expectation of reconciliation.”

The state of Texas defines adultery as “the voluntary sexual intercourse of a married person with someone other than his or her spouse.”

Texas Law Firm Bailey & Galyen Solicitors states on its website that “emotional affairs, inappropriate texting, or spending time with another person are not, by themselves, considered legal adultery.”

Kristy did not go into further detail about the alleged adultery in her divorce filing.

When it comes to her two children, sons Vance, 7, and Westin, 6, Kristy informed the court that she and Desmond plan to enter into a written agreement regarding custody, access and support.

However, if they can’t agree on terms for the children, Kristy wants the court to decide for them.

The TikTok star also said they signed a “marital property agreement,” which defines their rights to all property, both community and separate.

Kristy wants the court to enforce the property settlement, noting that “nothing in this petition should be construed as a challenge.”

Kristy said she and Desmond will come to an agreement to split their community property, likely referring to the “dream house” they built before their split.

The social media influencer also claimed that she owns a property that is not part of the community estate and wants the court to treat it as separate.

That’s not all.

we previously reported that Kristy made it clear that she no longer wants to the last name of her estranged husband and has asked the court to legally return his last name to Petit.

He also required Desmond to pay his attorney’s fees, as well as court costs and expenses related to the divorce case.

Kristy and Desmond married in August 2014. She didn’t give a separation date in her filing, but noted that they will “soon cease to live together as spouses.”

The couple became famous on social media with their hilarious prank videos and light-hearted content.

After her divorce filing, Desmond they addressed their separation and Kristy’s accusations.

“I want to start by apologizing to Kristy, our family and everyone who has been affected by the public attention surrounding this situation,” she announced via her Instagram story on Saturday, January 10. “I know this news has been disappointing to many, and I am truly sorry for the hurt it has caused.”

Desmond went on to explain, “Kristy and I faced challenges and made sincere efforts to overcome them. At the end of 2025, I wanted to separate and had conversations with Kristy about it. During that period, I made decisions that I’m not proud of.”

He also shared that he “took responsibility for these actions,” while promising to be “an active, present, and loving father to our children.”
